Terms of Service

Acceptance of these terms

By visiting our website, creating an account or using Polar Bears (the "Service"), you agree to these terms and to our Privacy Policy. If you use the Service for a company, you confirm you have authority to bind that company. If you do not agree, do not use the Service.

The Service

Polar Bears monitors the public LinkedIn and X activity of prospects you choose, shows you a daily queue of posts worth engaging with, drafts comment suggestions, keeps a warmth score for each prospect and sends alerts. CRM syncing with tools such as HubSpot and Salesforce is planned and may change before it is released.

Polar Bears does not log in to your social accounts and does not post, comment, connect or message for you. You decide what to post and you post it yourself. We may change, add or remove features over time.

Accounts

• Give accurate information and keep it up to date.
• Keep your credentials secure. You are responsible for activity under your account.
• Tell us promptly at mihirsodawalla01@gmail.com if you suspect unauthorised access.
• You must be at least 18 and able to form a binding contract.

Acceptable use

You agree not to, and not to let others:

• Break the terms of LinkedIn, X or any other platform you use alongside Polar Bears. You are responsible for knowing and following them.
• Send spam, bulk unsolicited messages or deceptive or harassing content.
• Use Polar Bears to automate actions on social accounts, or connect it to tools that do.
• Post comments or messages you have not reviewed. You are responsible for everything you post, including text drafted by our suggestions.
• Upload prospect data you have no right to use, or use the Service in breach of privacy, marketing or anti-spam laws.
• Scrape, reverse engineer or interfere with the Service, or try to bypass its limits or security.
• Use the Service for unlawful, discriminatory or harmful purposes, or to resell it without our written consent.

Customer data and licence

You keep ownership of the data you give us, including imported prospect lists and CRM data ("Customer Data"). You give us a limited licence to host, process and use Customer Data only to provide and support the Service, keep it secure and meet legal obligations.

You confirm that you have the rights and a lawful basis to import Customer Data and to have us process it. Where we process personal data for you, our Privacy Policy and any data processing agreement we sign with you apply.

We may use aggregated, de-identified data about how the Service is used to improve it.

Free trial, fees and billing

New customers can start a 14-day free trial with no credit card required. When the trial ends you can choose a paid plan, or your access may be limited or closed.

Paid subscriptions are billed in advance at the prices on our pricing page, in the billing period you choose. Subscriptions renew automatically until you cancel. Fees are non-refundable except where the law requires, and taxes are your responsibility. We may change prices with at least 30 days’ notice before your next renewal.

Our intellectual property

The Service, including its software, design, warmth scoring and branding, belongs to Mihir Sodawalla, trading as Polar Bears and our licensors. We give you a limited, non-exclusive, non-transferable right to use the Service during your subscription or trial. We keep all rights not expressly granted.

Feedback

If you send us ideas or suggestions, we may use them without restriction or payment, and you will not be owed anything for them.

Third-party services

The Service relies on and links to third-party services such as LinkedIn, X, HubSpot, Salesforce, Calendly and Vercel. We do not control them, and they may change or restrict access at any time. Your use of them is governed by their own terms, and we are not responsible for them.

Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise the Service will be uninterrupted or error free, that warmth scores or suggestions are accurate, or that it will lead to meetings, replies or sales.

Limitation of liability

To the fullest extent the law allows, Mihir Sodawalla, trading as Polar Bears will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose, or 100 US dollars if you have not paid us. Some places do not allow these limits, so they may not apply to you in full.

Indemnity

You will defend and indemnify Mihir Sodawalla, trading as Polar Bears against claims, losses and costs (including reasonable legal fees) arising from your Customer Data, your content on third-party platforms, your breach of these terms, or your violation of law or the rights of others.

Termination

You can stop using the Service or cancel at any time. We may suspend or end your access if you break these terms, put the Service or others at risk, or fail to pay. On termination your right to use the Service ends, and we will delete your data as described in our Privacy Policy. Sections that by their nature should survive, such as ownership, disclaimers, liability and indemnity, will survive.

Governing law

These terms are governed by the laws of India, without regard to conflict of law rules. Courts in that jurisdiction have exclusive jurisdiction, except that either of us may seek urgent relief in any competent court. Mandatory consumer protections in your home country are not affected.

Changes to these terms

We may update these terms. We will post the new version here with a new effective date and give customers reasonable notice of material changes. Continuing to use the Service after the effective date means you accept the updated terms.
